Terms of Service
Article 1: Purpose
These Terms of Service are intended to establish the rights, obligations, and responsibilities between Ninearth (hereinafter referred to as "the Company") and users when users utilize the global Web3 platform service that provides ownership of domain space (hereinafter referred to as "the Service").
Article 2: Definition of Terms
The definitions of terms used in these Terms are as follows, and the interpretation of undefined terms shall follow relevant laws and regulations, and guidelines separately established by the Company.
- "Service" means the login-free global Web3 platform service that provides ownership of domain space provided by the Company in web and mobile environments, and all related services.
- "User" means a person who accesses the Company's "Service" and uses the "Service" provided by the Company in accordance with these Terms.
- "Domain Space" means digitized content that implements a virtual 1:1 earth online and divides all regions worldwide into tiles of a certain size, which is unrelated to the ownership of actual registered real estate.
- "Domain Space Ownership" means blockchain-based digital assets issued with metadata information of "Domain Space" that grant specific rights to domain space owners regarding the corresponding "Digital Real Estate."
- "Blockchain Information" means information permanently recorded on the blockchain network due to the issuance, trading, and ownership transfer of domain space ownership.
Article 3: Implementation and Amendment of Terms
- The Company shall always post the contents of these Terms at the bottom of the webpage so that users can easily understand them.
- The Company may amend these Terms when necessary within the scope of not violating relevant laws and regulations.
- When the Company amends the Terms, it shall specify the effective date and reasons for amendment and notify both the current Terms and amended Terms together using the method in paragraph 1 from 7 days before the effective date of the amended Terms.
However, in case of amending the Terms unfavorably to users, notification shall be made from 30 days before the effective date.
Article 4: Characteristics of the Service
- This Service is a login-free blockchain-based global Web3 platform service that provides ownership of domain space, which can be used without separate membership registration procedures or provision of personal information.
- This Service is available only to adults aged 19 and above, and minors cannot use the Service.
- The digital real estate provided in this Service is virtual real estate content that implements domain space online and divides all regions worldwide into tiles of a certain size, and is unrelated to the ownership or legal rights of actual registered real estate.
- The Company does not store payment information, and all transactions are processed directly through the blockchain network.
- Due to the nature of blockchain, transaction records, ownership information, etc. are permanently recorded on the blockchain network, which is an area beyond the Company's control.
- After purchasing domain space ownership through this Service, users cannot receive refunds through the Company, but can sell their domain space ownership to other users.
However, the Company does not engage in sales and transactions in the secondary market.
Article 5: Information Processing
- The Company temporarily processes only minimal technical information unrelated to personal information for service provision:
- Domain space ownership issuance information unrelated to personal information
- Additional information such as order numbers for payment process progression
- The above information is used only for service provision and security purposes and is not provided to third parties.
- Information recorded on the blockchain is processed according to the policies of the corresponding blockchain network.
Article 6: Company's Obligations
- The Company shall comply with relevant laws, regulations, and these Terms, and strive to provide services continuously and stably.
- The Company shall establish security systems so that users can use the Service safely and continuously improve them.
- When the Company recognizes that opinions or complaints raised by users regarding service use are legitimate, it shall process them and may communicate the processing procedures and results through bulletin boards within the Service.
Article 7: User's Obligations
- Users shall not engage in any of the following acts:
- a. Modifying information posted by the Company
- b. Transmitting or posting information (such as computer programs) other than information designated by the Company
- c. Infringing on intellectual property rights such as copyrights of the Company and other third parties
- d. Acts that damage the reputation of the Company and other third parties or interfere with their business
- e. Publishing or posting obscene or violent messages, images, voices, false facts, or other information contrary to public order and morals on the Service
- f. Using the Service for commercial purposes without prior consent from the Company
- g. Accessing the Service through fraudulent means or causing load on the Company's servers
- h. Other illegal or unjust acts
- Users shall comply with relevant laws and regulations, Terms of Service, and matters announced by the Company in relation to the Service, and shall not engage in acts that interfere with the Company's business.
Article 8: Provision of Service
- The Company provides services 24 hours a day, 365 days a year.
However, the Company may divide the Service into certain ranges and separately designate available hours for each range, in which case it shall announce the contents in advance.
- The Company may temporarily suspend the provision of services in case of maintenance, replacement, and failure of computers and other information and communication facilities, interruption of communication, or significant operational reasons.
In this case, the Company shall notify users in advance through service announcements.
Article 9: Service Suspension and Termination
- The Company may restrict, suspend, or terminate all or part of the Service when any of the following reasons occur:
- a. When there is a significant business need of the Company
- b. When there is a need for maintenance, replacement, inspection, construction, etc. of service facilities
- c. When there is interference with normal service use due to power outages, facility failures, or usage surges
- d. When force majeure events such as natural disasters or national emergencies occur
- e. When service must be suspended according to the provisions of relevant laws
- f. Other cases deemed necessary by the Company
- When the Company terminates the Service, it shall notify users through service announcements at least 30 days before the termination date.
- Even when the Service is terminated, domain space ownership held by users remains permanently recorded and maintained on the blockchain network, and users can trade such digital assets through other platforms or secondary markets.
- The Company shall not compensate for damages arising from service termination.
However, this shall not apply when there is willful misconduct or gross negligence by the Company.
Article 10: Copyright and Trading of Digital Real Estate
- The copyright of digital real estate provided by the Company is protected by the Copyright Act of the Republic of Korea.
- Domain space ownership is a right to virtual digital content unrelated to actual registered real estate and does not grant ownership or legal rights to actual real estate.
- Users may freely sell domain space ownership directly purchased from the Company on other exchanges or secondary markets.
However, the Company does not engage in transactions in the secondary market and is not responsible for problems arising from such transactions.
- The Company has a usage license for digital real estate provided in the Service for the purposes of service operation, enhancement, improvement, new service development, and service promotion.
- Usage rights for domain space ownership are valid for 10 years from the date of acquisition, and users may renew them in 10-year increments before expiration.
If not renewed, usage rights for the corresponding domain space ownership may be extinguished.
Article 11: Attribution of Rights
- Copyrights and intellectual property rights to the Service belong to the Company.
- The Company grants users only the right to use the Service according to the terms of use established by the Company.
Article 12: Usage Restrictions and Refund Policy
- The Company may restrict service use in the following cases:
- a. In case of hacking and fraudulent incidents
- b. When government agencies request service restrictions according to relevant laws and regulations
- c. When involved or reasonably suspected of being involved in market manipulation, money laundering, unfair trading, criminal activities, etc.
- d. When other reasons equivalent to the above occur or measures are necessary to prevent them
- Refunds through the Company are not possible after purchasing domain space ownership.
However, users may dispose of their domain space ownership by selling it to other users in the secondary market, but the Company does not engage in transactions in the secondary market.
- Users must fully understand the non-refundable policy and secondary sale possibilities before purchasing domain space ownership and make careful decisions.
- Within the scope of usage restrictions in this Article, the conditions and detailed contents of restrictions are determined by the Company in operational policies.
Article 13: Permanence of Blockchain Information and Characteristics of Domain Space Ownership
- Users understand and agree that the following information is permanently recorded on the corresponding blockchain network due to the nature of blockchain:
- Domain space ownership issuance and transaction records
- Transaction details between wallet addresses
- Smart contract execution records
- The above information cannot be modified or deleted due to the nature of the blockchain network, and is an area beyond the Company's control.
- Users must understand that domain space ownership is virtual digital content unrelated to actual real estate and recognize that it does not grant any legal rights to actual real estate.
- Users must fully understand the permanence of information recorded on the blockchain and the characteristics of domain space ownership before using the Service.
Article 14: Notice
- When the Company notifies users, it may do so by posting announcements within the Service.
- When the Company notifies all users, it may substitute the notice in the previous paragraph by posting on the bulletin board within the Service for 7 days or more.
Article 15: Limitation of Liability
- When the Company or users cause damage to the other party by violating these Terms, they shall be liable to compensate for such damage.
However, this shall not apply when there is no intent or negligence on the part of the actor.
- When damage occurs to users due to the following reasons, if the Company proves that it has exercised necessary managerial care to prevent damage to users, the Company shall not be liable for such damage:
- a. In case of war, incident, natural disaster, or equivalent national emergency
- b. Compliance with de facto or legal administrative orders and measures by government agencies
- c. Service failures by telecommunications companies including telecommunications business operators under the Telecommunications Business Act
- d. Service restrictions due to blockchain network failures or characteristics
- e. Server failures due to temporary increases in service access
- The Company shall not be liable for damage caused by the permanence and immutability of information recorded on the blockchain network.
- The Company shall not be liable for damage caused by users' misunderstanding that domain space ownership is unrelated to actual real estate despite being virtual digital content.
- The Company shall not be liable for damage caused by the inability to provide refunds through the Company.
However, users may dispose of domain space ownership through sales in the secondary market, but the Company does not engage in transactions in the secondary market and is not responsible for problems arising from such transactions.
Article 16: Governing Law and Jurisdiction
- The laws of the Republic of Korea shall govern disputes between the Company and users.
- The Seoul Central District Court shall have jurisdiction over litigation regarding disputes between the Company and users.
Supplementary Provisions
These Terms of Service shall take effect from July 1, 2025.
